1. Acceptance

These Terms of Use govern your access to and use of https://labs.speedhost.net/, including its content, comparisons, recommendations, and speed-testing tools. By using the website, you agree to these Terms. If you do not agree, do not use the website. SpeedHost Labs is operated by Brittney Brown.

2. Informational Purpose

SpeedHost Labs provides independent educational guidance, a browser interface for third-party PageSpeed measurements, comparisons, and general recommendations. SpeedHost Labs does not currently claim proprietary hosting benchmarks. Content is not legal, financial, security, or other professional advice.

Hosting services, prices, promotions, specifications, policies, and performance can change. Verify important information directly with the applicable provider before purchasing or making a decision.

3. Performance Tests and Results

Performance results are estimates captured under particular conditions. Results can vary based on location, device, connection, caching, configuration, traffic, testing methodology, third-party services, and changes made by a hosting provider or website owner.

We do not guarantee that:

• a test will always be available, complete, or error-free;
• repeated tests will produce identical results;
• displayed data will be current at all times;
• a provider will deliver the same performance to every customer;
• using a recommended service will achieve a particular business, search, revenue, conversion, or technical outcome.

4. Your Speed-Test Submissions

You may submit only a public URL that you own, operate, or are otherwise authorized to test. You are responsible for every URL you submit.

Do not submit:

• private, internal, confidential, or access-restricted URLs;
• URLs containing passwords, tokens, API keys, session identifiers, personal information, or other secrets;
• URLs for testing that would violate law, contract, access restrictions, or another person’s rights;
• excessive or automated requests intended to disrupt the website or third-party services.

A submitted URL may be sent to Google PageSpeed Insights and processed under Google’s applicable terms and policies.

5. Acceptable Use

You may not:

• interfere with, overload, disable, or attempt to bypass the website’s security or request limits;
• use bots, scrapers, or automated systems in a manner that places an unreasonable load on the website;
• attempt to access non-public systems, data, source code, or administrative areas without authorization;
• introduce malware or use the website for unlawful, deceptive, abusive, or infringing activity;
• misrepresent SpeedHost Labs content, rankings, test results, or endorsements;
• reproduce or commercially exploit substantial portions of the website without written permission.

We may restrict or block access reasonably believed to violate these Terms or threaten the website or others.

6. Editorial Independence and Affiliate Links

Our recommendations reflect our editorial judgment and available evidence. Some links may be affiliate links. If you purchase through such a link, SpeedHost Labs may receive compensation, generally without increasing your price.

Compensation does not guarantee favorable coverage, placement, or a recommendation. Affiliate relationships are disclosed as described in our Affiliate Disclosure.

7. Third-Party Services

The website may display information about or link to third-party products and services. SpeedHost Labs does not own or control those services and is not responsible for their availability, security, support, billing, contracts, content, or conduct.

Your relationship with a hosting provider or other third party is governed by your agreement with that third party. A reference or link does not constitute a guarantee or legal partnership.

8. Intellectual Property

The website’s original text, design, branding, graphics, software, test presentation, compilation, and other original material are owned by or licensed to SpeedHost Labs and are protected by applicable intellectual-property laws.

You may access and use the website for personal or internal business evaluation. You may quote brief portions with clear attribution and a link to the relevant page. No other license is granted.

Third-party names, trademarks, and logos belong to their respective owners. Their appearance is for identification, comparison, or commentary and does not imply endorsement or affiliation.

9. Feedback

If you voluntarily provide suggestions or feedback, you grant SpeedHost Labs a non-exclusive, worldwide, royalty-free right to use that feedback without restriction or compensation, provided we do not publicly identify you without permission.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the website and all content, tools, data, and results are provided “as is” and “as available.” SpeedHost Labs disclaims all express and implied warranties, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, and non-infringement.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

11. Limitation of Liability

To the maximum extent permitted by law, SpeedHost Labs and Brittney Brown will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, goodwill, business opportunity, or data; service interruption; security incidents; or decisions made in reliance on website content or test results.

To the maximum extent permitted by law, total liability arising from or related to the website will not exceed the amount you paid directly to SpeedHost Labs for the applicable website service during the 12 months before the event giving rise to the claim, or US $100 if you paid nothing.

These limitations do not exclude liability that cannot lawfully be limited or excluded.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless SpeedHost Labs and Brittney Brown from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful or unauthorized URL submissions, misuse of the website, or material violation of these Terms.

13. Changes and Availability

We may change, suspend, or discontinue any part of the website and may update these Terms. Updated Terms become effective when posted with a revised effective date. Your continued use after that date constitutes acceptance of the updated Terms.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms or the website must be brought in a state or federal court with jurisdiction over Clay County, Florida, unless applicable law requires otherwise. You and SpeedHost Labs consent to the personal jurisdiction of those courts.

15. Severability and Waiver

If any provision is found unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

16. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms clearly presented for a particular feature, constitute the entire agreement concerning your use of the website.
